Terms of Service

These Terms of Service (“Terms”) govern your use of swooperhq.com, the Swooper desktop app, the Swooper iOS app, and related services (together, the “Service”). By using the Service you agree to these Terms. If you don’t agree, don’t use the Service.
1. What Swooper is
Swooper is software that monitors participating retailers for product restocks, sends alerts, and — depending on your plan — can automate steps of the online purchase process such as joining queues, adding to cart, and completing checkout. Swooper is an independent tool and is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, Target, Walmart, or any retailer.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service.
3. Subscriptions, billing & the launch offer
- Paid plans are billed through Whop on a recurring basis until cancelled. You can cancel anytime; access continues until the end of the paid period.
- The limited-time launch offer (3 months of Premium for a one-time payment) grants Premium access for three months, after which access ends automatically unless you start a new plan.
- Prices and plan features may change; changes apply to future billing periods.
4. Acceptable use & retailer terms
Important — read this. Automated interaction with retailer websites may violate those retailers’ terms of service. You are solely responsible for how you use the Service. By using Swooper you acknowledge and agree that:
- You use automation features at your own risk and discretion;
- Retailers may cancel orders, restrict, or ban accounts that use automation, and Swooper is not responsible for those outcomes;
- Swooper does not guarantee that any product will be detected, carted, or successfully purchased;
- You will not use the Service for any unlawful purpose, to resell or redistribute the software, to reverse engineer it, or to disrupt the Service or other users.
5. License
Subject to these Terms, we grant you a personal, non-transferable, non-exclusive, revocable license to use the Service for your own use. We retain all rights in the software and content. Your access is tied to your license and may not be shared.
6. Third-party services
The Service relies on and links to third parties (Whop, Discord, Supabase, captcha and proxy providers, retailers). Your use of those services is governed by their terms, and we are not responsible for them.
7. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will result in any purchase.
8. Limitation of liability
To the maximum extent permitted by law, Swooper and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost purchases, cancelled orders, or banned accounts. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months before the claim.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.
10. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located there.
11. Changes
We may update these Terms. Continued use of the Service after changes take effect means you accept the updated Terms.
